General Terms and Conditions of Sale
This e-commerce website (hereinafter referred to as the "Website") is owned by Il Prato S.r.l., with its registered office at San Marco Calle delle Ostreghe 2456 – 30124 – VENICE (Italy), tax code 02016000271.
These General Terms and Conditions of Sale, which govern the online purchase of products sold by Il Prato S.r.l. and constitute an integral part of the transaction, are intended for Users of the Website who declare themselves to be adults under Italian law and who intend to make use of such service (End Customers). These General Terms and Conditions of Sale are governed by Legislative Decree of 6 September 2005, No. 206 (Consumer Code). Il Prato S.r.l. complies with the obligations set forth in Legislative Decree of 9 April 2003, No. 70 (Implementation of Directive 2000/31/EC on certain aspects of information society services, in particular electronic commerce, in the internal market). The sale of products through this website is intended exclusively for the personal use of Users, excluding any professional purpose. All texts, images, and designs derived from the products and product images present on this website are protected under Law 633/1941 and Legislative Decree 30/2005. Their use (even partial) is prohibited.
Conclusion of the Contract and Acceptance of the General Terms and Conditions of Sale
By completing and submitting the purchase order form in accordance with the following guidelines, the Customer shall be deemed aware of and accepts these General Terms and Conditions of Sale. Il Prato S.r.l. will send the Customer an order confirmation by e-mail within 3 (three) business days from receipt of the purchase order form following the completion of the check-out procedure: the contract shall be deemed accepted only after the dispatch of such communication. Failure to receive such order confirmation within the above-mentioned deadline shall constitute cancellation of the order. Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for the non-acceptance, even partial, of an order by Il Prato S.r.l., is hereby excluded.
By submitting the order to Il Prato S.r.l., the Customer acknowledges and declares that they have reviewed all instructions provided during the purchase procedure and accept in full the general terms and conditions of sale, delivery, payment, shipping, and shipping costs. Pursuant to Article 13 of Legislative Decree 70/2003, the Customer will receive by e-mail the necessary information for the identification of the seller (as indicated in the sales contract), as well as a summary of the submitted purchase order, as specified below. The Customer shall retain such documentation. Once the online purchase procedure has been completed, the Customer shall print and retain these "General Terms and Conditions of Sale," which must not be modified in any way, having already reviewed and accepted them as a mandatory step in the purchase procedure; the Customer shall also print and retain the specifications of the purchased products, in compliance with the conditions set forth in Articles 52 and 53 of Legislative Decree 206/05.
The terms of sale may be modified at any time by Il Prato S.r.l. (Seller), provided that – with regard to this contract – those published in the e-commerce area as of the date of the Purchase Order submitted by the Customer shall apply; pursuant to applicable Laws, the latter shall be solely responsible for the use of this end-user reserved area, in particular with regard to the communication of incorrect or false information, or third-party data, without the express consent of those concerned; or for purchases made for non-personal purposes.
The purchaser is expressly prohibited from entering false or fabricated data during the registration procedure required for order processing, and it is also expressly prohibited to make duplicate registrations for a single person or to enter third-party data.
In the interest of and for the protection of all consumers, Il Prato S.r.l. reserves the right to take legal action against any violation or breach. By submitting an order, the Customer acknowledges and accepts the processing of their personal data within the limits established by the Code on Data Protection and the Privacy Policy of Il Prato S.r.l. The data collected and recorded on this website constitute full proof of the transactions concluded between the Customer and Il Prato S.r.l. In the event of a dispute between the Customer and Il Prato S.r.l. regarding a transaction made on this website, the data recorded by Il Prato S.r.l. shall constitute full proof of such transaction and its content.
Purchase Instructions
The Customer may only purchase products that are listed in the online catalogue and described in the product pages at the time of order submission. Users may browse the pages of this Website without any obligation.
To place an order, the Customer must register on the Website by completing the registration form, clicking on the "Register" option through the user icon located in the upper right corner, present in the menu of every page, and entering the requested data. The registration must be confirmed by the user through the e-mail verification procedure. Registration is free and allows Customers to carry out the following activities: modify delivery and billing information, make purchases, send communications and request information from customer service, and cancel the account.
If a user, after logging in, wishes to place a purchase order, they shall select various products of their interest by adding them to the cart. Each new product added to the cart will be indicated through a specific window. Users must at all times be able to view the selected products and modify their order by clicking on the "shopping bag" icon located in the upper right corner of every page, resume the selection and purchase of products, or complete the product selection and finalize the check-out order by clicking the "Proceed to checkout" button on the "Cart" page and pressing the "Place your order now" button on the checkout page. During the check-out process, they will see a summary of their order, and upon completing the purchase procedure, they will be shown the costs and any VAT deduction for extra-EU orders.
Price
The price is indicated in EUROS and includes VAT, in compliance with current Italian regulations at the time of shipment, for Italy and European Union countries. Orders not included within EU countries may be subject to customs duties and/or taxes that are collected once the product reaches the destination country. For more information on the customs policies of the destination country, it is necessary to contact the relevant Office. Il Prato S.r.l. is not liable for such customs duties and/or taxes, and such costs are always borne by the customer; in this regard, they are not calculated and are excluded from any amount owed to Il Prato S.r.l. by the customer.
For extra-EU countries, prices do not include customs duties and/or taxes. The price, however, does not include shipping costs, which may be specified separately.
Il Prato S.r.l. reserves the right to modify at any time the prices published on the Website. Products are subject to the price indicated on the site at the time of order, without any consideration of previous offers or possible price changes, except in the case of a transcription error. In the event of an error in the price of an item, Il Prato S.r.l. will contact you as soon as possible; customers will have the option to reconfirm their order at the correct price or cancel it. In the event that Il Prato S.r.l. is unable to contact the customer, the order will be cancelled due to the pricing error.
Delivery Times
The average time for receiving ordered products is indicated in the product description. Should Il Prato S.r.l. be unable to deliver the ordered goods due to technical-production unavailability, Il Prato S.r.l. will promptly notify the Customer by e-mail. The times required for international deliveries may vary depending on the destination country. Il Prato S.r.l. shall not be held liable for delays or failures in delivery caused by force majeure or fortuitous events. For custom-made or special-format deliveries, Il Prato S.r.l. will send the Customer a specific communication specifying the costs of possible shipping solutions, to allow the Customer to make the most suitable choice (express courier, insured parcel, etc.). Such document does not constitute final acceptance of the order by Il Prato S.r.l.
Shipping Charges
Shipping costs are calculated at the time of payment based on the destination country. The shipping price includes insurance costs on the goods up to 8 (eight) days after delivery. Prices are calculated automatically based on the weight and dimensions of the goods.
Import Duties (Extra-EU Countries Only)
Import taxes, duties, and tariffs due for extra-EU countries are not included in the final costs, which are always applied to the end recipient. The customer may be contacted by border agents for the import of goods by providing formal documents.
Payment Methods
Il Prato S.r.l. accepts payments via bank transfer and debit/credit cards. Payment by debit/credit card: The charge for the purchase will be made at the time of order fulfillment by Il Prato S.r.l., confirmed to the customer by e-mail. By choosing debit/credit card as the payment method, the customer will be charged the amount of the purchase. Il Prato S.r.l. will not have access to credit card information, nor use a database for the recording of such data. No database of Il Prato S.r.l. will store such information, and in no case will Il Prato S.r.l. be held liable for any fraudulent or improper use of credit cards by third parties at the time of payment for products purchased on the Website. In the event of order cancellation, Il Prato S.r.l. will request the cancellation of the authorization obtained and the release of the committed amount. Il Prato S.r.l. reserves, in particular cases, the right to request additional information from the customer or the submission of copies of documents proving ownership of the card used. Should the customer fail to provide such information and/or copies, Il Prato S.r.l. reserves the right not to accept the contract despite having sent the confirmation e-mail.

Payment must be made within 7 (seven) days from the date of order fulfillment communicated to the customer by e-mail. The reference for the bank transfer must necessarily include: order number (printed on the e-mail received at the end of the purchase procedure), order date, and the customer's first and last name.
Product Information
The items offered for sale by Il Prato S.r.l. are those present on the Website, as of the date on which the User consults the Website, subject to their availability. The photographs illustrating the products are not part of this contractual framework; therefore, Il Prato S.r.l. shall not be held liable for any errors and/or discrepancies. Consequently, Il Prato S.r.l. shall not be held liable for errors and/or inaccuracies in the graphic and photographic reproduction of products on its website, as:
- there may be differences in the representation of the product due to the resolution and type of screen of the Customer's computer;
- each product is a handcrafted creation and as such a unique piece; therefore, each one will not have substantial variations in shape, size, or color compared to what is shown in the video.
Order Receipt and Order Confirmation
The correct execution of the order is confirmed by Il Prato S.r.l. via e-mail, sent to the email address provided by the Customer. The order confirmation e-mail includes: the identification number, the purchase date; the indication of the products purchased, the relevant price, delivery costs, the data provided by the Customer for invoicing and delivery, and the payment method chosen by the Customer. The Customer is required to immediately verify the content of the communication and to promptly report any errors or omissions to Il Prato S.r.l. Warranties, Returns, and Refunds
Warranties
All products sold by Il Prato S.r.l. are covered by the legal warranty for defects of conformity, as provided for in Articles 128–135 of Legislative Decree No. 206/2005, to be reported within 7 (seven) days from discovery. To benefit from the warranty, the customer must retain the delivery documentation for the goods. Non-substantial variations in shape, size, and color, which are inevitable and typical of the product's craftsmanship and that distinguish its artisanal nature, shall not be considered defects of conformity.
Right of Withdrawal
In compliance with Article 67 and Article 54-bis of Legislative Decree 206/2005 of the Consumer Code, a private customer (not holding a VAT number) may exercise their right of withdrawal (also known as "right of reconsideration") for a purchase contract made online through our website or by telephone with our sales operators, that is, for a contract negotiated outside business premises and at a distance, as indicated in Article 52 of the Consumer Code.
The withdrawal request is made through a simplified, automated, and traceable procedure.
To exercise this right, the customer must access the private area of their own account and use the procedure named "Right of Withdrawal."
This procedure involves completing a form intended to identify the purchase contract by entering, by the customer, the following data: Order Number, Order Date, Customer First Name, Customer Last Name, contact email, phone number including international prefix. Completion of the "reason for withdrawal" field is optional. Once confirmed by the user, the form will be sent electronically to the operators of Il Prato Srl's sales office. A copy of the communication receipt will be immediately sent to the customer at the email declared in their account. The order number referred to in the purchase contract can be found in the confirmation e-mail and in the order history accessible in their account.
We would like to inform you that the withdrawal request must be made within 14 (fourteen) days from the date of delivery of the products provided for in the purchase contract.
The right of withdrawal cannot be exercised on all those products customized at the express request of the customer, except for damaged or defective products.
The right of withdrawal cannot be exercised for contracts of modest amount (Article 47, paragraph 2, Consumer Code). For the purposes of qualifying a "contract of modest amount," the limit provided is equal to 50 euros, in accordance with what is established by EU regulations.
If you decide to return the product within the 14-day reconsideration period, you must bear the postage and packaging costs.
Returns and Refunds
Returns are accepted only in case of defective products or for any error made by Il Prato Srl. The customer must send a notification by e-mail to info@giobagnaravenezia.com within 8 (eight) days from receipt of the order, indicating the problem related to the goods received. Il Prato Srl, after assessing the problem, will assist and guide the customer with a resolution in case of exchange or return based on any particular case and request. A refund will be processed in the event that the purchased goods are not available for exchange or due to exceeding delivery times in the production process. All requests will be processed by e-mail at info@giobagnaravenezia.com, where Il Prato Srl will assist and guide the customer by requesting all necessary information to refund the order in whole or in part. The refund process may take up to 20 (twenty) business days, during which the customer may request a status update of the process by e-mail.
Limitation of Liability
Il Prato S.r.l. shall in no way be held liable for improper, erroneous, or unsuitable use of the products sold. Il Prato S.r.l. is not liable for the actions of third parties, acting as independent agents, who intervene in the management or execution of payment operations, delivery of goods, and any other operation connected to the performance of contracts concluded on the Website. Il Prato S.r.l. is not liable for any fraudulent or unlawful use that may be made by third parties of credit cards and other means of payment at the time of payment for products purchased. At no point during the purchase procedure is Il Prato S.r.l. able to know the purchaser's credit card number, which, through a secure connection, is transmitted directly to the banking service.
Force Majeure
Neither party shall be liable for total or partial non-performance or for delay in the performance of their obligations arising from this contract that is caused by an event that cannot be prevented (force majeure). The force majeure event may include, without limitation, war, riot, insurrection, serious disruptions in Internet protection, technical failures, unauthorized access and/or intrusion into the website server, any form of strike, or telephone/telecommunications failures. If a party believes that a force majeure event has occurred, it must notify the other party within 5 (five) business days from the occurrence of the event or from the risk of such event occurring. The parties agree to meet in order to jointly determine the terms and conditions for the completion of orders during the occurrence of a force majeure event.
Governing Law and Jurisdiction
The sales contract between the customer and Il Prato S.r.l. is governed by Italian law. For any disputes relating to sales contracts between the customer (as a private consumer) and Il Prato S.r.l. concluded through the Website, territorial jurisdiction shall be, without exception, that of the court of the place of residence or domicile of the customer, if located in Italy. In all other cases, territorial jurisdiction shall be, without exception, that of the Court of Venice.
Customer Service
Complaints
Any complaints from the Customer must be submitted by contacting Il Prato S.r.l. via e-mail: info@giobagnaravenezia.com. Our team will respond to all requests within 48 hours. Il Prato S.r.l. shall not be liable for any damages, losses, and costs suffered by the Customer as a result of non-performance of the contract, the Purchaser having the right only to a full refund of the price and any costs incurred.
